St. Louis Landlord Sued for Black Mold infestation

As more has become known about the dangers of mold, property owners are being held accountable for infestations in their buildings. A St. Louis landlord is currently being sued based on discovery of black mold in a rental home.

Did the Landlord Exercise Reasonable Care?

In March 2015, Patrick and Chastity Phillips leased a home in Alton, MO for themselves and their four children. The lawsuit claims that, unbeknownst to them, the house was infested with black mold which was discovered when they moved out.

Defendants include Rashad Robinson; CR Property Investments, LLC; CR Investments; Robinson Realty; and Especial Services and Renovations. The lawsuit alleges failure to maintain a reasonably safe property and prevent mold growth.

Health Dangers of Indoor Mold

According to the Centers for Disease Control (CDC), exposure to mold indoors is not always a risk. However, people can experience allergic reactions to mold ranging from mild to severe, depending on their level of sensitivity.

The Institute of Medicine (IOM) has determined that evidence shows a link between mold exposure and upper-respiratory allergic reactions in otherwise healthy individuals, as well as a link to respiratory illnesses in children.

The Phillips family claims that exposure to mold caused them to incur serious health problems such as permanent pain and injury along with mental anguish and disability. Their suit asks that the defendants pay the costs of past and future medical treatment.

Suing A Landlord Over Mold

Mold is a serious problem and can cause severe health issues in many people. When you lease a property for your home or business, you have certain legal rights regarding the condition of the property. Landlords are responsible for keeping the premises fit for human habitation for the duration of the lease. If you have a problem with mold in a property that you are leasing, contact the landlord as soon as possible.

Conditions that result in mold

Mold needs three things to grow: Moisture, food, and proper temperature. Moisture can exist in the air due to a leaky roof or inadequate ventilation. It can also come from plumbing leaks, standing water in a crawlspace, a damp basement, or poor drainage allowing water to enter the building.

These issues alone can cost a lot of money to fix. However, our NYC mold removal method is not expensive, and properly addressing these problems is less costly for the landlord than ignoring the matter and ultimately being required to pay for legal fees, mold inspection, replacing damaged personal property, medical expenses, and emotional distress.

If you have to sue your landlord

Ideally, your landlord values you as a tenant and will make every effort to maintain a good relationship with you. Do your part to keep good will in this legal relationship, if that’s possible.

Landlord responsibilities regarding mold aren’t always clear. There are no federal standards for permissible exposure limits in buildings and you may have to pay for a professional inspection and air quality test to prove a health risk exists. Consult an attorney and contact the mold experts at Stern for NYC mold removal.

Mold, Now Called a BioAerosol, Can Cause Hypersensitivity Disease

Mold Spores Stay in the Air Causing Health Problems

Mold Spores Can Cause Hypersensitivity Disease

Health scientists have recently improved their understanding of why mold causes illness. As you may already know, you don’t need to touch mold to get sick, because you’re already breathing it in. Like airborne germs, mold particles infiltrate our indoor air as a “bioaerosol.”

Bioaerosols such as mold and other fungi are known to cause allergy-related illnesses called hypersensitivity diseases.

Hypersensitivity diseases take many forms depending on the type of mold exposure and the individual. The four most common mold-related illnesses according to NJDOH are:

Building-related asthma: Coughing, shortness of breath, chest pains. May occur immediately or hours later.

Allergic rhinitis: Itchy eyes and runny or stuffy nose symptoms.

Hypersensitivity pneumonitis: Fever, coughing, fatigue, weight loss, and other acute symptoms of pneumonia. Often comes back repeatedly.

Humidifier fever: Fever, chills, and cold symptoms associated with mold or other biotoxins being dispersed by a humidifier.

Unfortunately, once a person has a hypersensitivity, just a small amount of the mold particles can re-trigger the symptoms at any time. So, if your home has a mold infestation you need to bring in our NJ mold treatment professionals.

Stern’s NJ Mold Treatment Offers Permanent Protection

Typical household cleaners can only partially remove a mold problem, and untreated mold spores can easily grow back.

Stern Mold uses a two-part process of antimicrobial cleaning followed by a polymer seal. We destroy the mold, then add a blocking layer so the spores will never cause another outbreak. You can breathe easy, especially because our NJ mold treatment doesn’t require breaking into walls and ceilings.

Mold 101: the CDC Weighs in On Mold and Damp Buildings

the CDC Weighs in On Mold and Damp Buildings

The Centers for Disease Control and Prevention (CDC) recognizes the health risks associated with high indoor humidity, dampness and mold in offices, schools, and other nonindustrial buildings. You work hard to keep your business profitable, maintain a safe and comfortable environment for your employees and customers, and to keep customers coming back every time they need your products or services. A musky smell from leaking pipes or water incursion can’t be masked and it can ruin your business. People with sensitive immune systems and mold allergies feel the effects of mold spores quickly when they’re in a building with mold. Our Manhattan mold removal company can help you at a reasonable price and without tearing out walls.

The CDC defines dampness as any unwanted or excessive moisture inside your building. Having this dampness in your building will lead to mold growth that releases mold spores and breaks down building materials. Different types of mold grow in different moisture conditions. The CDC warns that mold inside buildings is associated with several respiratory problems including asthma, hypersensitivity pneumonitis, bronchitis, and respiratory infections. People sensitive to allergens and those with weakened immune systems are at higher risk of developing a more severe illness from their exposure to mold.

We can remedy your mold problem with our Manhattan mold removal service. Our MoldExterm method is faster and less costly than traditional remediation methods. It does not require tearing out walls and can be done with little or no interruption to your business schedule. Contact Stern Mold for a free professional inspection and consultation on the best way to maintain optimal air quality and prevent mold from coming back.

Sloppy and ineffective removal of mold and fungus can end up making the problem worse instead of resolving it. New York is one of several states that have enacted training requirements to protect consumers.

New York Adds Strict Regulations for Mold Assessors and Contractors

Here are the significant points of the mold law that took effect in New York during the past year.

• As of January 1, 2016, anyone working in the mold remediation industry must be properly trained and licensed. This includes assessors, contractors and all of their employees.

• Any jobs involving mold remediation or disturbance must be reviewed by a licensed mold assessor at both the start and completion of the project.

• All mold removal and clean-up jobs must be conducted by a licensed remediation contractor.

• According to the mold legislation, anyone holding a license to perform mold-related services is specifically barred from conducting both the assessment and the remediation.

• Violations of the mold law can result in civil penalties that range from $2,000 to $10,000.
